By booking with Louise Rayner Photography you agree to abide by the terms and conditions as set out below. These terms and conditions shall not be varied except by agreement in writing.

Booking Fee & Balance

The booking fee secures the confirmation of booking and is non-refundable. Following payment of the booking fee, the balance of fees are due to be paid on or immediately after the photo shoot. No photographs will be delivered until all payments have been received.

Cancellation & Postponement

The client may cancel this contract at any time by giving written notice, but in doing so shall forfeit any monies paid. If the photo shoot is postponed, due to sickness, bad weather or any other unforeseeable circumstance, Louise Rayner Photography will aim to reschedule to a new date and time. If this is not possible, the deposit will be returned to the client.

Force Majeure

Louise Rayner Photography shall exercise all reasonable skill, care and diligence in the discharge of their duties. It is understood that, in the event of any unforeseen exceptional circumstances, outside the control of Louise Rayner Photography, causing loss of photographic record, Louise Rayner Photography will only be responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs.

Creative Licence

Save as otherwise agreed between the client and Louise Rayner Photography, Louise Rayner Photography shall be entitled to use its judgement regarding the style and artistic input in the production of pictures. This includes, but is not limited to, locations, poses and number of images taken. Due to the vagaries of weather and the willingness of subjects, it may not be possible to capture all the pictures requested by the client. In the event of uncooperative children at a session of any kind, for any reason, Louise Rayner Photography may not be able to capture any, or all the images, the client may have requested or expected. The client is responsible for all children at all sessions.

Louise Rayner Photography reserve the creative right to edit and release only images deemed fit as professional in quality and within its artistic standards. Images are fully edited before being presented to the client. Requests for additional edits are carried out at the discretion of Louise Rayner Photography, who reserve the right to charge the client accordingly.

Copyright & Reproduction

Louise Rayner Photography retains copyright of all its images, in accordance with the Copyright, Designs & Patents Act 1988.

Digital images are provided to the client with personal reproduction and display rights. These rights grant the client permission for unlimited personal printing and the display of the images on personal websites, including Facebook. The client is not permitted to use the photographs for any personal or commercial gain.

Advertising & Promotion

Louise Rayner Photography reserve the right to use all images for advertising and promotional purposes.

Storage of Images

Original digital images are stored electronically by Louise Rayner Photography for a period of 6 months, after which time they may be subject to deletion without notice.

Delivery

Unless otherwise agreed, digital images will be delivered within 2 weeks of the photo shoot having taken place, using Royal Mail's First Class service.

Client Confidentiality

Louise Rayner Photography will keep confidential and will not disclose client details to any third parties or make use of material or information communicated to her in confidence for the purposes of the photography, save as may be reasonably necessary to enable Louise Rayner Photography to carry out her obligations in relation to the commission.

Applicable Law

This agreement is governed by the laws of England and Wales.
